Policies & Terms of Service

These are the exact policies referenced in our family waiver. Every signer affirms they have reviewed these terms before electronically signing. If you have questions, please contact us before submitting your consent.

About This Document

Foley Prep, Inc. (“Foley Prep”) provides academic tutoring, test preparation, and related educational services. These policies outline expectations for students, families, and staff. Signing or checking the acknowledgment boxes confirms you agree to the terms below for yourself and any dependent linked to your account.

Communications & Media Consent

Email Communications

I consent to receive email reminders, schedules, score reports, planning updates, invoices, and program resources from Foley Prep. You may adjust preferences or opt out through your account or reply instructions at any time.

Text Messaging

I consent to receive SMS/text notifications, including scheduling updates and reminders. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase.

Media & Promotional Consent

I authorize Foley Prep to reference anonymized success highlights, stories, or media featuring my family or student. Foley Prep will remove full names and personally identifying information. You may withdraw media consent at any time by emailing info@foleyprep.com.

Policies & Expectations

Scheduling & Cancellation

1-on-1 Sessions (Appointments)

The following peak season policy applies to all 1-on-1 tutoring sessions held during the peak periods that Foley Prep announces each year:

Peak Season Policy

During any announced peak season window, all schedule changes and cancellations require seven (7) full days' advance notice from the scheduled session time.

Peak season dates are published in our scheduling emails and account dashboard notices as they are announced each year.

The following policy applies to all 1-on-1 tutoring sessions with a session start time outside of any active peak season period:

Non-Peak Season Policy

All schedule changes and cancellations require 48 hours (2 days) advance notice from the scheduled session time.

As a courtesy to clients who have purchased certain packages, we offer a one-time exception to the Peak Season and Non-Peak Season policies above:

One-Time Courtesy Exception

We offer a single exemption from our schedule change and cancellation policies for a client's first schedule change or cancellation. Sessions changed or cancelled under this exception are not charged or forfeited. Any subsequent schedule changes or session cancellations with less than the required advance notice will result in full session charges.

Schedule Changes, Cancellations, and No-Shows

  • When a schedule change or session cancellation is submitted with at least the required advance notice indicated above, the client is not charged for the session.
  • Schedule changes or session cancellations submitted with less than the required advance notice indicated above are considered Late Cancellations.
  • No-Shows, which occur when a student does not attend a scheduled session, are also considered Late Cancellations.
  • When a session cancellation is considered a Late Cancellation, the client is charged for the session, and the session time slot is forfeited.
  • Certain session types cannot be cancelled under any circumstances. These restrictions apply to specialized session formats that require specific preparation or coordination.

Small-Group Classes and Enrollments

  • Classes that are not part of an enrollment group may be cancelled at any time before the session begins, provided all other general requirements are met.
  • Enrollments cannot be cancelled individually. These small-group sessions are bound by the enrollment group's terms and conditions.

Mock Exams

  • Mock Exams may be cancelled at any time before the session begins, provided all other general requirements are met.

Academic Outcomes

Tutoring, coaching, and advising support student growth but do not guarantee scores, grades, or admissions decisions. Results depend on engagement, practice, and factors outside Foley Prep’s control.

Materials & Intellectual Property

All curriculum, practice materials, recordings, and resources shared by Foley Prep are proprietary. Families agree not to reproduce, distribute, or sell these materials without written authorization.

Learning & Testing Disclosures

To tailor support safely, you agree to share information about IEP/504 plans, testing accommodations, psychological or medical diagnoses, and any conditions that may affect instruction or exam-day arrangements so we can match the right tutor and make reasonable adjustments.

General Liability & Assumption of Risk

You acknowledge that academic coaching involves ordinary risks, including scheduling changes, technology interruptions, or performance variability. Foley Prep is not liable for ordinary negligence. This waiver does not limit rights in cases of gross negligence or willful misconduct.

Non-Solicitation of Tutors

Families agree not to hire or solicit Foley Prep tutors for independent engagements during their program and for one year after their last billed session. This protects staffing investments and ensures consistent instruction quality.

Service & Billing Terms

Enrollment & Payment

Enrollment confirms your commitment to the selected services. Tuition must be paid in full at registration unless a written payment plan is approved. Credit card data is securely stored by Stripe for ongoing programs.

Storage & Prepayment of Services

Prepaid balances are maintained on your account for future scheduling. You authorize Foley Prep to apply stored balances and previously authorized payment methods toward sessions you schedule or approve.

Refunds & Withdrawals

Refunds follow these guidelines: 100% refund 10+ days before the first session; 85% refund 2-9 days before; 50% refund within 24 hours after the first session; no refunds after that window. College planning retainers are non-refundable once services begin.

Service Changes & Cancellations by Foley Prep

If Foley Prep alters, postpones, or cancels a service and no acceptable alternative is available, fees already paid will be refunded in full. Additional remedies are limited to the amount paid.

Outside Work & Additional Tutoring

Tutor-prepared reports, emails, or custom assignments performed outside of scheduled sessions are billed in 15-minute increments at the applicable hourly rate once the family approves the work.

Program Dismissal

Foley Prep reserves the right to dismiss any student for non-payment or disruptive conduct. Dismissed students are not entitled to refunds for completed or scheduled services.

Expiration of services

Unless otherwise stated, any unused services will expire six (6) months after purchase.

Transfer of services

Unused, non-expired services can be transferred to siblings for a $100 transfer charge. Services cannot be transferred to non-siblings.

Service Agreement

You enroll in services with Foley Prep, Inc. (“Foley Prep”) for the purpose of preparing for a particular high school, college or graduate admissions test, other entry or standardized exam, for high school academic tutoring, or for preparing for the college search and application process. You understand that course size is limited, and there are only a certain amount of available staff hours. Therefore, all sessions are offered on a first-come, first-served basis.

Payment

You must pay the entire fee at the time of enrollment with one of the payment methods offered for the service. The client agrees to open an account with Foley Prep. Accepted forms of payment are cash, checks, debit cards, or credit cards. Credit card information is stored by Stripe, a secure third-party payment processor. The client will receive by email a detailed invoice for total fees incurred with the addition of required sales tax.

Student Withdrawal and Refunds

If you choose to withdraw your enrollment in a classroom course, online course, or small group instruction ten or more days before the first scheduled session of your program, Foley Prep will refund all of the fees you have paid to date. If you decide to withdraw your enrollment less than ten (10) days before the start of the first session, Foley Prep will refund all of the fees you have paid less 15%. If you choose to withdraw your enrollment within 24 hours after the first session, you will be refunded 50% of the fees paid. There will be no refunds available 24 hours after the first session. There are no refunds for college planning retainers.

Service Cancellation

Occasionally, due to various circumstances, Foley Prep may change course schedules, cancel a course, not have a tutor available for you, or not be able to fulfill your small group instruction request. If we cancel the course in which you are enrolled and are not able to reschedule you in another course acceptable to you, or we are unable to match you with a tutor or instructor, we will refund all of the fees you have paid to date, and we will have no further liability to you with regard to the cancelled program. Please note that refunds for cancellations take approximately 10 days from notification to be processed.

Dismissal from program or online access

Foley Prep may dismiss you from the program if you have not paid in full by the first scheduled session or if you, in Foley Prep's opinion, are disruptive in the program. Foley Prep will not refund any amounts paid by students who are dismissed from a program. Foley Prep may also disable your access to any online resource we provide if you do not comply with our terms of use or other rules and procedures applicable to such resource.

For Students Enrolling in a Private Tutoring Program

You have purchased private tutorial services for the number of hours indicated in your package. Please note that session lengths are in one hour increments. Tutoring packages expire in one year from purchase. Foley Prep does not refund any unused tutoring hours after the expiration date.

Payment for Additional Tutoring Hours

Once you complete the tutoring hours purchased, you authorize Foley Prep to charge you via your stored payment method for the additional hours you schedule at the undiscounted rate of your original service. You may choose one of the discounted package fees at any time before the next upcoming session not covered by the original package. Discounted rates are not retroactive to previously completed sessions.

Payment for Additional Tutor Work

Telephone, research and/or email correspondence between the tutor and the student/parent performed on behalf of the client will be billed in 15 minute increments at the applicable rate. It is the tutor's responsibility to inform the client that work outside of their 1-on-1 session needs to be performed. The client must approve the tutor to bill outside of the regularly scheduled session by filling out an authorization form.

Appointments

All student services are scheduled on a minimum of one hour basis. The student may choose in-house or online sessions. Clients have the ability to book, change, or cancel their own sessions choosing any available subject, tutor, date, or time using the online session scheduling software. The link is located on the Foley Prep website home page. In-house sessions are available during regularly scheduled office hours. Online sessions via Zoom, Google Meet, or Facetime are available at each tutor's discretion. Tutoring is based on one student per tutor unless authorized in advance by Foley Prep.

Adult Supervision

All in-person services offered will be in Foley Prep's offices during regular business hours. Tutors are not permitted to meet in person with a student outside of Foley Prep's office unless in an online format, such as Skype or Facetime, without prior consent of Foley Prep. Tutors do not have any time constraints in offering online services. Any date or time is acceptable to Foley Prep as long as both the tutor and student/parent are in agreement with the scheduled online session.

Outside Tutoring Solicitation

Parents and students are prohibited from soliciting or arranging tutoring services with Foley Prep tutors outside of official company channels. This includes but is not limited to direct hiring, private arrangements, or any tutoring services not coordinated through Foley Prep. Such arrangements violate our service agreement and may compromise the quality and integrity of our educational services. All tutoring services must be scheduled and conducted through Foley Prep's official booking system to ensure proper oversight, quality control, and adherence to our professional standards.

Satisfaction

If you are not happy with your tutor we have assigned you or you have chosen, please notify Foley Prep in writing with specific details as to your discontent before your second tutorial session. We will assign a new tutor. You may request not to be charged for the first session if you feel such action is warranted. Foley Prep will make the decision to honor your request on a case-by-case basis and will respond back to you in writing.

Forfeiture of Tutoring Hours

If after you have had your first or subsequent tutoring sessions, there is not a tutoring session scheduled over 12 months, all unused tutoring hours will be forfeited at the end of the 12 month period and your Foley Prep account will become inactive.

Governing Law

This Service Agreement and any claim or dispute arising out of, relating to, or in connection with this Service Agreement, or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of New Jersey without giving effect to its conflicts of law principles.

No Guarantee

Foley Prep does not in any way guarantee results on exams, grades, or admissions outcomes.

Privacy Policy

Privacy Policy

Protecting your private information is our priority. For the purposes of this Privacy Policy, unless otherwise noted, all references to Foley Prep include foleyprep.com and Foley Prep, Inc. This Statement of Privacy applies to Foley Prep and governs data collection and usage. The Foley Prep website is a news, information, and e-commerce site. By using the Foley Prep website, you consent to the data practices described in this statement.

Collection of your Personal Information

Foley Prep may collect personally identifiable information, such as your name. If you purchase Foley Prep's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. Foley Prep may also collect anonymous demographic information, which is not unique to you, such as your age and gender. We may gather additional personal or non-personal information in the future.

Information about your computer hardware and software may be automatically collected by Foley Prep. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Foley Prep website.

Foley Prep encourages you to review the privacy statements of websites you choose to link to from Foley Prep so that you can understand how those websites collect, use and share your information. Foley Prep is not responsible for the privacy statements or other content on websites outside of the Foley Prep website.

Use of your Personal Information

Foley Prep collects and uses your personal information to operate its website(s) and deliver the services you have requested.

Foley Prep may also use your personally identifiable information to inform you of other products or services available from Foley Prep and its affiliates. Foley Prep may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Foley Prep does not sell, rent or lease its customer lists to third parties. Foley Prep may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Foley Prep, and they are required to maintain the confidentiality of your information.

Foley Prep will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Foley Prep or the site; (b) protect and defend the rights or property of Foley Prep; and, (c) act under exigent circumstances to protect the personal safety of users of Foley Prep, or the public.

Children Under Thirteen

Foley Prep does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

Disconnecting your Foley Prep Account from Third Party Websites

You will be able to connect your Foley Prep account to third party accounts. By connecting your Foley Prep account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you, including personally identifying information, to be shared in this manner, do not use the this feature. You may disconnect your account from a third party account at any time.

Opt-Out & Unsubscribe

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from Foley Prep by marking the options in your account profile.

Changes to this Statement

Foley Prep will occasionally update this Statement of Privacy to reflect company and customer feedback. Foley Prep encourages you to periodically review this Statement to be informed of how Foley Prep is protecting your information.
