Cancellation Policies:

Peak Season Booking Policy:

All 1-on-1 appointments from:
are prepaid, non-refundable, and non-changeable. If you cannot make it to an in-person session, you can change it to online at the same time, but if you cannot make either, you will be charged for the session. Every year for the past 4 years we put this policy in place for the weeks leading up to March and August SAT exams. We do this to maintain peace and order in the schedule. We realize that there may be last minute changes in your child’s schedule due to covid, sports, sickness, accidents, etc., but during this peak period our tutors’ time slots are very scarce and we want to guarantee that we have time for your child, so we cannot make exceptions. So please plan ahead!

Non-Peak Season Booking Policy:

Private Tutoring:
We define “rescheduling” as the same as “canceling.” Standing appointments can be lost if the client cancels. No-shows and late canceled appointments are subject to 100% charge regardless of sickness or other reason. For all booked appointments, the following fee applies:

*During peak times we have a prepaid, no-refund policy that has no time limits. Also, clients who repeatedly cancel will be subject to a prepaid, no-refund policy. See above for details.

Classes and Tests:

Please reserve classes at least 24 hours in advance to ensure we can provide the best service for your child. Reserving in advance guarantees your spot since class sizes are limited and registrations are accepted on a first-come basis. Foley Prep reserves the right to modify and remove classes at our discretion.

While there is no penalty for cancelling or missing a class, we kindly ask that you notify us of any schedule updates in advance.

Other Policies and Procedures:

Expiration of services: Unless otherwise stated, any unused services will expire 1 year after purchase.

Transfer of services: Unused, non-expired services can be transferred to siblings for a $100 transfer charge. Services cannot be transferred to non-siblings.

Service Agreement: You enroll in services with Foley Prep, LLC (“FP”) for the purpose of preparing for a particular high school, college or graduate admissions test, other entry or standardized exam, for high school academic tutoring, or for preparing for the college search and application process. You understand that course size is limited, and there are only a certain amount of available staff hours. Therefore, all enrollments and appointments are offered on a first-come, first-served basis. Clients can make their own appointments online for up to 90 days before their requested time.

Payment: You must pay the entire fee at the time of enrollment with one of the payment methods offered for the service. The client agrees to open an account with FP. Accepted forms of payment are cash, checks, debt cards (except those requiring a PIN), or credit cards (VISA, MasterCard, Discover, and American Express). Credit card information is stored in a database using Extended DES encryption. The client will receive by email a detailed invoice for total fees incurred with the addition of required sales tax.

Student Withdrawal and Refunds: If you choose to withdraw your enrollment in a classroom course, online course, or small group instruction ten or more days before the first scheduled session of your program, FP will refund all of the fees you have paid to date. If you decide to withdraw your enrollment less than ten days before the start of the first session, FP will refund all of the fees you have paid less 15%. If you choose to withdraw your enrollment within 24 hours after the first session, you will be refunded 50% of the fees paid. There will be no refunds available 24 hours after the first session. There are no refunds for college planning retainers.

Service Cancellation: Occasionally, due to various circumstances, FP may change course schedules, cancel a course, not have a tutor available for you, or not be able to fulfill your small group instruction request. If we cancel the course in which you are enrolled and are not able to reschedule you in another course acceptable to you, or we are unable to match you with a tutor or instructor, we will refund all of the fees you have paid to date, and we will have no further liability to you with regard to the cancelled program. Please note that refunds for cancellations take approximately 10 days from notification to be processed.

Dismissal from program or online access: FP may dismiss you from the program if you have not paid in full by the first scheduled session or if you, in FP’s opinion, are disruptive in the program. FP will not refund any amounts paid by students who are dismissed from a program. FP may also disable your access to any online resource we provide if you do not comply with our terms of use or other rules and procedures applicable to such resource.

For Students Enrolling in a Private Tutoring Program – In Person or Online: You have purchased private tutorial services for the number of hours indicated in your package. Please note that session lengths are in one hour increments. You may schedule the hours in any manner you choose, such as two hours together. Tutoring packages expire in one year from purchase. FP does not refund any unused tutoring hours after the expiration date.

Payment for Additional Tutoring Hours: Once you complete the tutoring hours purchased, you authorize FP to charge your credit card or debit account for the additional hours you schedule at the undiscounted rate of your original service. You may choose one of the discounted package fees at any time before the next upcoming appointment not covered by the original package. Discounted rates are not retroactive to previously completed appointments.

Payment for Additional Tutor Work: Telephone, research and/or email correspondence between the tutor and the student/parent performed on behalf of the client will be billed in 15 minute increments at the applicable rate. It is the tutor’s responsibility to inform the client that work outside of their private appointment needs to be performed. The client must approve the tutor to bill outside of the regularly scheduled appointment by filling out an authorization form.

Appointments: All student services are scheduled by private appointment only on a minimum of one hour basis. The student may choose in-house or online appointments. Clients have the ability to book, change, or cancel their own appointments choosing any available subject, tutor, date, or time using the online appointment scheduling software. The link is located on the FP website home page. In-house appointments are available during regularly scheduled office hours. Online appointments via Skype or Facetime are available at each tutor’s discretion making tutoring a possibility 24 hours a day, 7 days a week, 365 days a year. Tutoring is based on one student per tutor unless authorized in advance by FP.

Adult Supervision: All in-person services offered will be in FP’s offices during regular business hours. Tutors are not permitted to meet in person with a student outside of FP’s office unless in an online format, such as Skype or Facetime, without prior consent of Foley Prep. Tutors do not have any time constraints in offering online services. Any date or time is acceptable to FP as long as both the tutor and student/parent are in agreement with the scheduled online appointment.

Satisfaction: If you are not happy with your tutor we have assigned you or you have chosen, please notify FP in writing with specific details as to your discontent before your second tutorial session. We will assign a new tutor. You may request not to be charged for the first session if you feel such action is warranted. Foley Prep will make the decision to honor your request on a case-by-case basis and will respond back to you in writing.

Forfeiture of Tutoring Hours: If after you have had your first or subsequent tutoring sessions, there is not a tutoring session scheduled over 12 months, all unused tutoring hours will be forfeited at the end of the 12 month period and your FP account will become inactive.

Governing Law: This Service Agreement and any claim or dispute arising out of, relating to, or in connection with this Service Agreement, or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of New Jersey without giving effect to its conflicts of law principles.

No Guarantee: Foley Prep does not in any way guarantee results on exams, grades, or admissions outcomes.

Protecting your private information is our priority. For the purposes of this Privacy Policy, unless otherwise noted, all references to FP include www.foleyprep.com and Foley Prep, LLC. This Statement of Privacy applies to FP and governs data collection and usage. The FP website is a news, information, and e-commerce site. By using the FP website, you consent to the data practices described in this statement.

Collection of your Personal Information

FP may collect personally identifiable information, such as your name. If you purchase FP’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. FP may also collect anonymous demographic information, which is not unique to you, such as your age and gender. We may gather additional personal or non-personal information in the future. Information about your computer hardware and software may be automatically collected by FP. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the FP website. FP encourages you to review the privacy statements of websites you choose to link to from FP so that you can understand how those websites collect, use and share your in- formation. FP is not responsible for the privacy statements or other content on websites outside of the FP website.

Use of your Personal Information

FP collects and uses your personal information to operate its website(s) and deliver the services you have requested. FP may also use your personally identifiable information to inform you of other products or services available from FP and its affiliates. FP may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered. FP does not sell, rent or lease its customer lists to third parties. FP may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to FP, and they are required to maintain the confidentiality of your information. FP will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on FP or the site; (b) protect and defend the rights or property of FP; and, (c) act under exigent circumstances to protect the personal safety of users of FP, or the public.

Security of your Personal Information

FP retains the services of MINDBODY Processing (MB) as their merchant service provider. MB maintains Digital Properties and all associated data with technical, administrative and physical safeguards to protect against loss, unauthorized access, destruction, misuse, modification and improper disclosure. When you enter sensitive information (such as a credit card number) on our order forms, MB encrypts the transmission of that information using secure socket layer technology (SSL). No computer system or information can ever be fully protected against every possible hazard. MB is committed to providing reasonable and appropriate security controls to protect our web sites and information against foreseeable hazards. Children Under Thirteen

FP does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website. Disconnecting your FP Account from Third Party Websites You will be able to connect your FP account to third party accounts. BY CONNECTING YOUR FP ACCOUNT TO YOUR THIRD PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THE THIS FEATURE.
